Bequest Language for Donors

The following is intended to help you and your attorney in drafting a bequest that satisfies your interests. 

As you consult your attorney on the selection of appropriate wording to reflect your own goals and intentions regarding Presbyterian SeniorCare Foundation, be sure our organization’s correct legal name appears in all final documents as:

 

“Presbyterian SeniorCare Foundation, 1215 Hulton Rd. Oakmont, PA 15139, a Pennsylvania nonprofit corporation, or its successor, Federal Tax Identification Number: 56-228960.”

General Bequest of a stated sum of money may be worded:

“I give, devise and bequeath to Presbyterian SeniorCare Foundation, a not-for-profit organization, organized and existing under the law of the Commonwealth of Pennsylvania, with offices presently located at 1215 Hulton Road, Oakmont, PA 15139, Allegheny County (ein number 56-2289600) sum of ($          ) or (      % of my disposable estate) or (description of property)  or (residual of estate) to be used without restrictions.”

Specific Bequest of a certain asset from your estate may be worded:

"I give, devise and bequeath to Presbyterian SeniorCare Foundation, a not-for-profit organization, organized and existing under the law of the Commonwealth of Pennsylvania, with offices presently located at 1215 Hulton Road, Oakmont, PA 15139, Allegheny County (ein number 56-2289600) the sum of ($          ) or (      % of my disposable estate) or (description of property) or (residual of estate) to be used for (charitable care, capital needs, etc or a specific location such as Woodside Place, Shenango on the Green, Oakmont Campus, etc.)"

An Endowment Bequest, after other bequests and expenses have been paid, may be worded:

"I give, devise and bequeath to Presbyterian SeniorCare Foundation, a not-for-profit organization, organized and existing under the law of the Commonwealth of Pennsylvania, with offices presently located at 1215 Hulton Road, Oakmont, PA 15139, Allegheny County (ein number 56-2289600) the sum of ($          ) or (      % of my disposable estate) or (description of property) or (residual of estate) to go to the permanent Charitable Care Endowment Fund.  If at any time in the opinion of the Board of Directors it becomes impossible or impractical to use this bequest for such purposes, then the income may be used for such other closely aligned purposes as shall most nearly accomplish my wishes."

Contingent Bequest if the person making the will is not survived by certain individuals:

“I give and bequeath the residue of the property, real and personal and wherever situate, owned by me at my death to my spouse, (insert name), if she/he survives me. If my spouse does not survive me, I give and bequeath my residuary estate to Presbyterian SeniorCare Foundation, a not-for-profit organization, organized and existing under the law of the Commonwealth of Pennsylvania, with offices presently located at 1215 Hulton Road, Oakmont, PA 15139, Allegheny County (EIN number 56-2289600) to be used without restrictions.”
